  1. INTRODUCTION

 

  • These General Terms and Conditions of Sale (hereinafter "GTC") are offered by the foreign company KABUSHIKI KAISHA MARUYAMA NORI TEN, trading as JUGETSUDO BY MARUYAMA NORI, with a capital of 10,000,000 yen, registered with the Paris Trade and Companies Register under number 480 192 384, whose registered office is located at 1 23 Akashicho Chuo-ku, Tokyo, Japan and whose main establishment in France is located at 95 rue de Seine, 75006 Paris (hereinafter "the Company")

  • The Company is the publisher of the website jugetsudo.fr (hereinafter the “Site”).

 

  • The Company offers the Customer (hereinafter "the Customer"), having the status of consumer within the meaning of the provisions of the Consumer Code, the possibility of ordering on the Site tea, accessories and products relating to tea, pastries (hereinafter the "Products") and gift vouchers for workshops related to tea (hereinafter the "Gift Vouchers").

 

 

  1. APPLICATION AND ENFORCEABILITYE Terms and Conditions

 

  • These General Terms and Conditions of Sale define all the conditions under which the Company sells the Products and Gift Certificates as offered for sale on the Website to Customers. They therefore apply to any Order ("Order") of Products and Gift Certificates placed on the Website by the Customer.

 

  • The Customer declares to have read and accepted these GCS before placing his Order.

 

  • The validation of the Order therefore implies acceptance of these GCS. These are regularly updated, the applicable T&Cs are those in force on the Site on the date the Order is placed.

 

 

  1. TECHNICAL RESOURCES

 

  • Before using the Site, the Customer must ensure they have the necessary technical and computer resources to use the Site and order Products and Gift Certificates, and that their browser allows secure access to the Site. The Customer must also ensure their computer hardware/equipment is in good working order and free of viruses.

 

 

 

  1. CREATING A PERSONAL ACCOUNT

 

  • In order to place an order, the customer has the option of creating a personal account on the website.

 

-The Customer can create a user account without placing an Order. In this case, only an email address will be required. The default password will be generated by the Site and sent by email. The Customer can then log in and change the password.

-The customer can create an account and place an order using that account. In this case, they will be asked for their first name, last name, gender, company name (if applicable), VAT number (if applicable), country, postal address, and telephone number. Their email address will be pre-filled, as it was registered when the account was created. Payment information (credit card, bank transfer, or check, depending on their preference) will also be requested.

-The customer may place an order without creating an account beforehand. In this case, they will be asked for their first name, last name, gender, company name (if applicable), VAT number (if applicable), country, address, telephone number, and email address. Payment information (credit card, bank transfer, or check, according to their preference) will also be requested.

-Either the client is a professional and creates a professional account. In this case, they will be asked for the following information to create the account: First name, Last name, Telephone (optional), Email, company name (optional), and a password.
When placing an order, he will need to add his gender, country, address, and VAT number. He will also be asked for his payment information (credit card, bank transfer, or check, according to his preference).

 

  • The Client agrees to provide the Site with valid, truthful, complete and up-to-date information.

 

  • The Client also undertakes not to infringe the rights of third parties and in particular their intellectual property rights, personal data and their images.

 

  • Usernames and passwords are strictly personal. The Client must inform the Company immediately of any loss of this information, and the Company will provide a link allowing the Client to change their password. The Company accepts no liability for the loss or misuse of this information.

 

  1. ORDERING PRODUCTS AND GIFT CERTIFICATES ON THE WEBSITE

 

  • The Customer selects the Product(s) and Gift Certificate(s) they wish to purchase, and can access their Order summary at any time.

 

  • The main characteristics of the Products and Gift Vouchers are presented on the Site, which the Customer is required to read before ordering.

 

  • The order summary lists the product(s) and/or gift certificate(s) selected by the customer, and includes any additional charges such as delivery fees added to the price of the product(s) in the order. The customer has the option to modify their order and correct any errors before accepting it.

 

  • After reviewing the order summary, the Customer confirms acceptance of their order by checking the box to accept the Terms and Conditions, and then clicking the order confirmation icon. The phrase "Order with obligation to pay" or any similar, unambiguous wording appears next to the order confirmation icon to ensure that the Customer explicitly acknowledges their obligation to pay for the order.

 

  • After acceptance of the Terms and Conditions and validation of the Order, the contract is validly concluded between the Company and the Client and binds them irrevocably, except for the exercise of the right of withdrawal.

 

  • After validating their delivery and, where applicable, billing details, the Customer proceeds to pay for their Order according to the terms specified herein.

 

 

  1. PRICE AND CONDITIONS OF PAYMENT OF THE ORDER

 

  • Prices are listed on the Site in the descriptions of the Products and Gift Vouchers, in euros and inclusive of all taxes.

 

  • The total amount is shown in the order summary before the customer accepts these terms and conditions, confirms their order, enters and confirms their delivery and, if applicable, billing details, and proceeds to payment. This total amount includes all taxes.

 

  • Orders for Products and Gift Certificates on the Site are payable in euros. Full payment can be made by the Customer on the day of the Order by credit card, check, or bank transfer.

 

  • If paying by check, it must be made payable to Jugetsudo By Maruyama Nori. The check, along with a copy of the order confirmation email, must be sent to the following address: Jugetsudo By Maruyama Nori, 95 rue de Seine, 75006 Paris, France. The Company will proceed with the delivery of the product(s) or the confirmation of the gift certificate(s) upon receipt of the check. If the check is not received within 15 (fifteen) days of the order, the Company will send the customer an order cancellation email.

 

  • The Site uses the SHOPIFY PAYMENTS payment interface. The system guarantees the Customer complete confidentiality of their banking information. The bank card transaction between the Customer and the secure system is therefore fully encrypted and protected. The Customer's bank details are not stored electronically by the Company.

 

  • The Customer warrants to the Company that he/she has the necessary authorizations to use the payment method when placing the Order.

 

  • The Company reserves the right to suspend or cancel any execution and/or delivery of an Order, regardless of its nature and stage of execution, in the event of non-payment or partial payment of any sum owed by the Customer to the Company, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the site and the payment of an Order.

 

 

  1. STOCK AVAILABILITY AND WORKSHOP BOOKING FOR GIFT VOUCHERS

 

  • The product(s) is/are offered and delivered subject to available stock.

 

  • In the event of an Order encountering a stock shortage, the Company will contact the Customer as soon as possible to offer them the option of postponing the delivery of the ordered Product(s) until they are restocked or receiving a refund.

 

  • Apart from the refund of the price of the unavailable Product(s), the Company is not liable for any cancellation compensation.

 

Gift certificates are only valid for sessions scheduled by the Company, namely on Saturdays or by appointment. The Client must contact the Company to find out the dates of use.
